Siegel's Legal Argument

Among the people suing Michael Bloomberg and the City Council to block them from extending term limits is attorney Norman Siegel, who said there may be “an implicit restraint” applicable to changing a law legislatively that was created by a public referendum, such as term limits.

Siegel, speaking at a protest on the City Hall steps just now, said that five state courts have dealt with the issue. Two have said yes (Connecticut and Washington) and three have said no (New Jersey, Maryland and Illinois).

“So, that’s as divided as you can get,” said Siegel.

Towards the end of the 30-minute press conference, Michael Bloomberg quietly walked into City Hall. Nobody at the press conference made a fuss, and when one photographer began photgraphing him, the mayor smiled and waved.
